Simien & Miniex
has represented the Louisiana Public Service Commission as
special counsel since 1991. The firm was first retained by the
Commission in 1991 to monitor the progress of an anti-trust
suit filed as a class action lawsuit against TransLA and
Louisiana Intrastate Gas.
Other matters Simien & Miniex was retained to represent the
Louisiana Public Service Commission are as follows:
- A full rate case in 1992 when the Southwest Louisiana
Electric Membership Corporation SLEMCO) filed its application
for a rate increase of $4.2 million dollars (Docket No.
19755 Southwestern Louisiana Electric Membership Corporation
In Re: Proposed Revision of Electrical Rates and Charges
within Acadia, Lafayette, St. Landry, St. Martin, Vermillion,
Avoyelles, Evangeline, Iberia and Jefferson Davis Parishes,
Louisiana). Simien and Miniex in said case, in conjunction
with the consultant employed in that matter, conducted a
complete review of SLEMCO's rates and recommended to the
Commission that the request for increased rates be denied. The
Commission voted unanimously in favor of Simien & Miniex’s
recommendation.
- Simien and Miniex, as co-counsel with Stone, Pigman,
Walther, Wittmann and Hutchinson, a New Orleans based law
firm, has represented the Commission before the Third Circuit
Courts of Appeal and the Louisiana Supreme Court in The
Daily Advertiser, et al vs. Trans-La. et al 612 So.2d 7 (La.
1993).
- Simien & Miniex also represented the Commission before the
19th Judicial District Court at the appeal portion of the
SLEMCO matter, Docket No. 393943. Simien and Miniex has also
advised the Commission regarding SLEMCO's AM-7 loan
commitment. In that matter, SLEMCO sought permission from the
Commission to draw down on said loan commitment approximately
5.8 million dollars for the payment of construction cost. The
general issue regarding said loan funds was whether the
construction was used and useful from a regulatory view such
that it could be included in a rate base.
- Simien & Miniex has also represented the Commission in
Docket No. U-23812 - Louisiana Public Service Commission, ex
parte. In re: An investigation into the allegations filed by
the plaintiffs against the defendants in Case No. 532-058 in
the 24th Judicial District Court. (The Rhodes Company Inc., et
al versus Citizens Utilities Company) ("Citizens"), LGS
Natural Gas Company ("LGS Natural"), LGS Intrastate Inc., ("LGSI")
and Louisiana Gas Service Company ("LGS") which resulted in
over $27,000,000.00 in refunds to ratepayers.
- Simien and Miniex also completed the first PGA Audit
pursuant to the Commissions General Order dated March 24, 1999
(Paragraph VI(A)) in Docket
Number U-25117 entitled In re: Commission Audit of Purchased
Gas Adjustment Filings of Louisiana Gas Service Company
pursuant to Commission General Order dated March 24, 1999
(Paragraph VI(A)). This audit was conducted on Louisiana Gas
Company.
- Simien and Miniex is in the final stages of another PGA
audit of Centerpoint Energy Entex, a division of CenterPoint
Energy, Inc. a sister company to Centerpoint Energy Arkla.
This matter is LPSC Docket U-26721 and entitled In re:
Commission Audit of Purchased Gas Adjustment Filings of
Reliant Energy Entex pursuant to Commission General Order
dated March 24, 1999. An audit report was presented before the
Commission in this matter.
